2. Cancellation and Refund Policy
- Cancellation by Client: 7 days until charter date full refund. 5 days until charter date %50 percent. Less than 5 days no refund.
- Cancellation by Company: If we cancel your charter due to unforeseen circumstances (such as inclement weather, equipment failure, or other circumstances beyond our control), we will provide a full refund.
- Inclement Weather: In the event of inclement weather, we reserve the right to reschedule or cancel the charter, or to proceed with the charter at our discretion. If we cancel or reschedule due to inclement weather, a full refund will be provided.
3. Payment Terms
- Deposit: A non-refundable deposit (if any) is required to secure your booking.
- Balance: The balance of the charter fee is due prior to the start of the charter.
- Payment Methods: We accept credit card, bank transfer, or other payment methods as agreed upon with the Client.
4. Responsibilities of Client and Captain
- Client Responsibilities: The Client is responsible for:
- Arriving at the designated departure location on time.
- Following all instructions provided by the Captain.
- Bringing any required safety equipment.
- Complying with all applicable laws and regulations.
- Not interfering with the vessel's operation or equipment.
- Captain Responsibilities: The Captain is responsible for:
- Operating the vessel in a safe and prudent manner.
- Ensuring the vessel is seaworthy and in good working condition.
- Conducting a safe and enjoyable charter for the Client.
5. Limitations of Liability
- Company Liability: We are not liable for any damages or losses arising from:
- Weather-related events.
- Acts of God.
- Equipment failure or defects.
- Client negligence or misconduct.
- Third-party activities or events.
- Client Liability: The Client agrees to hold harmless and indemnify the Company, its officers, directors, employees, and agents against any claims, damages, or losses arising from Client negligence or misconduct.
6. Disclaimer of Warranties
- Vessel Condition: The Vessel is provided on an "as-is" basis, and we make no warranties regarding its condition or seaworthiness.
- Safety Equipment: We provide safety equipment, but the Client acknowledges that this equipment may not be sufficient for all circumstances.
7. Governing Law and Jurisdiction
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.
- Jurisdiction: Any disputes arising from these Terms shall be brought in the courts of the State of Florida, and the parties agree to submit to the jurisdiction of such courts.
